ARTICLE 1 - GENERAL
The buyer acknowledges having read these general conditions of sale (CGV) before placing his order. These General Terms and Conditions apply exclusively to all sales of our products, owned by the company KOOROO™, whether for its own account or that of its principals. Any other conditions will only be applicable after written confirmation from us. By placing an order or accepting a sale offer, the buyer accepts these general conditions without reservation. Any condition contrary to our General Terms and Conditions, formulated by the buyer, will be rejected unless we have expressly recognized its applicability in writing. These General Terms and Conditions may be modified at any time and without notice by the company KOOROO™, the modifications then being applicable to subsequent orders.
ARTICLE 2 - ORDERS
Orders become effective upon receipt of payment. The customer can request a refund under the conditions of article L 121-20-1. KOOROO™ undertakes to deliver to the buyer as soon as possible. Except in exceptional circumstances (postal service strike, unforeseen events, etc.), delivery will be made within the deadlines indicated on the website www.koo-roo.com. However, lead times may be longer (for example, during Christmas periods), which the buyer understands and accepts.
ARTICLE 3 - PRICE
The seller's price list does not constitute an offer to sell. It may be modified unilaterally without notice before purchase by the customer. The goods are invoiced at the agreed price at the time of delivery, within the limit of the option period and general economic conditions (taxes, exchange rates, etc.). All prices indicated on the seller's website are net, in euros, all taxes included, excluding transport costs which will be specified before the order is registered by the buyer. Prices may be subject to promotions, sales and other discounts.
ARTICLE 4 - PAYMENT
All orders must be paid in euros. Full payment of the price must be made at the time of ordering by the buyer. At no time can the amounts paid be considered as deposits or deposits. To pay for their order, the buyer must have a credit card or PayPal account. Payment by card or PayPal is fully secured by the Secret Socket Layer (SSL) protocol, ensuring data encryption to prevent fraudulent use. The order will be shipped upon receipt of payment. The buyer guarantees to KOOROO™ that he has all the necessary authorizations to use the payment method chosen when registering the order. KOOROO™ reserves the right to suspend or cancel any order and/or delivery in the event of non-payment or payment incident, regardless of their nature and level of execution. KOOROO™ also reserves the right to request a photocopy of the buyer's identity card and/or proof of address for any order. As part of the fight against Internet fraud, information relating to the order may be checked.
ARTICLE 5 - CHOICE OF ARTICLES
The buyer, having read the products and their characteristics marketed by KOOROO™, chooses with full responsibility, according to his previously determined needs, the products which are the subject of his order. In the event of unavailability, and without calling into question the provisions of article 2, KOOROO™ can provide a product of equivalent quality and price.
ARTICLE 6 - WARRANTY
All products sold by KOOROO™ are subject to a warranty. This warranty applies only to products sold by KOOROO™ and used in accordance with the corresponding recommendations and instruction manuals. The warranty period is specified on the product sheets on the site www.koo-roo.com. In any case, the products are guaranteed for 1 year.
Reasons for exclusion of the guarantee:
- Willful damage: damage intentionally inflicted on the product.
- Improper use contrary to recommendations or instruction manuals.
- Failure to comply with safety instructions.
- Cosmetic damages.
In the event of a breakdown or damage covered by the warranty and not repairable, KOOROO™ undertakes to replace the defective part or product with a new one if the part cannot be repaired or replaced.
ARTICLE 7 - DELIVERY
Delivery time: All our products are in stock in our warehouse in France. Your order will be shipped within a maximum of two working days from our logistics center, unless otherwise indicated on the product sheet or when finalizing the order. You will then receive a tracking number from our transport provider to be able to track your package. Delivery is generally made within a maximum of 72 working hours.
General rules: The products will be delivered to the address indicated by the buyer when ordering. In the event of absence, a delivery notice will be left in your mailbox, allowing you to reschedule a delivery or collect the products ordered from an establishment of your choice, within the time limit indicated by the carrier on the delivery notice. .
Delivery problems: The buyer is required to check, in the presence of the carrier, the condition of the packaging, contents and functioning of the goods upon delivery. If the buyer has the slightest doubt, he must follow the return procedure (in particular report the damage noted, any complaints and reservations) and refuse the goods by immediately establishing a report of an anomaly with the delivery person. It is necessary to report these incidents within 3 days from the refusal of the goods, stating the complaints or reservations.
Quality or conformity problems: In the event of delivery of a product that does not conform to the order (defective or non-compliant), the buyer must make his complaint within 5 days of signing the distribution slip. Complaints must be sent via the contact form and must include the buyer's contact details, order number, product references and reasons for the complaint. The return procedure will then be communicated. Products returned by the buyer must be returned within a maximum period of 15 working days from the date of delivery or return authorization.
ARTICLE 8 - RESERVATION OF OWNERSHIP
In accordance with the law, ownership of the goods delivered to the buyer will only be transferred after full payment of the price in principal and incidentals, or cashing of accepted checks or other means of payment issued in settlement of the price. During the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the buyer. In the event of non-payment by the buyer, whatever the cause, the seller has the right to demand immediate return of the delivered goods, at the expense and risk of the buyer.
ARTICLE 9 - RIGHT OF WITHDRAWAL AND RETURNS
Right of withdrawal:
The French buyer legally benefits from a right of withdrawal of 30 days from the day after he takes possession of the product. Return costs are his responsibility. This right of withdrawal also applies to sale products sold on www.koo-roo.com.
The refund will be made within 14 days of receipt of the returned product by KOOROO™. The buyer must inform KOOROO™ of his decision to withdraw beforehand. This decision must be notified using the contact form. KOOROO™ will inspect the returned product to verify its condition.
Returns:
Please refer to the warranty exclusions mentioned in article 6. The buyer must return the product in its original packaging, unused, with all its accessories, indicating the reason on the invoice.
The buyer can then choose from the following options:
- A new delivery in accordance with the order.
- Repair of the defective product.
- The exchange of the product with another similar one.
- Cancellation of the order and full refund of the price of the returned product.
